EMPLOYMENT

I don't have a contract of employment

Every employee has a legal right to a contract of employment. This is a written statement which sets out your terms and conditions of employment. This should be given to you within 2 months of starting your job. It should include, for example:-

bulletName of your employer
bulletWhere you will be working
bulletWhen you commenced work
bulletSalary details ie amount and how and when you will be paid
bulletHours of work
bulletHoliday entitlement
bulletHoliday and sick pay
bulletPension details
bulletNotice
bulletDisciplinary rules

What is the minimum I should be paid?

We have a national minimum wage in the UK which means you must not be paid less. For most workers this is £4.10 per hour (October 2001) but if you are aged between 18 and 22 then you can be paid £3.20 per hour. Or if you are over 22 but are in the first six months of training you can still be paid £3.20 per hour.

How many hours can my employer make me work?

The Working Time Regulations say that you should not work more than 48 hours a week on average, unless you have agreed in writing to work more.

What do I do if I have been unfairly dismissed

There may be a basis for compensation and this depends on your contract of employment. You are advised to seek advice from a solicitor as to the type and amount of compensation you may claim in this instance.
